Terms of Service

1. Acceptance of Terms

By downloading, installing, or using FirstOfCAD ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

FirstOfCAD is a professional Computer-Aided Design (CAD) application for iPad and Mac that provides 2D drafting, 3D modeling, file format compatibility (DWG, DXF, STEP, IGES), Apple Pencil support, and related professional design tools.

3. Subscription Terms

  • Free Trial: New users receive a 7-day free trial with full access to all features. No credit card is required to start the trial.
  • Monthly Subscription: After the trial, you may subscribe on a monthly basis at the current price listed on the App Store.
  • Yearly Subscription: An annual subscription is available at a discounted rate.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
  • Price Changes: We reserve the right to change subscription prices. You will be notified in advance of any price changes.

4. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use FirstOfCAD for:

  • Personal use (individual projects, learning, hobby)
  • Commercial use (professional work, client projects, business operations)

You may install the App on any Apple devices associated with your Apple ID, as permitted by Apple's App Store terms.

5. Intellectual Property

  • Our Property: FirstOfCAD, including its code, design, features, documentation, and brand elements, is our intellectual property and is protected by copyright and trademark laws.
  • Your Content: You retain full ownership of all drawings, designs, and content you create using FirstOfCAD. We claim no rights to your work.
  • Restrictions: You may not copy, modify, distribute, sell, or reverse-engineer the App or any part of it.

6. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not use the App to create harmful, offensive, or illegal content
  • Maintain the security of your account credentials
  • Keep your own backups of important drawing files
  • Not attempt to bypass subscription requirements or security measures

7. Data and Privacy

Your use of FirstOfCAD is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. iCloud Sync

If you enable iCloud sync, your drawing data will be stored in your personal iCloud account. We are not responsible for data loss due to iCloud service interruptions, storage limits, or Apple account issues. We recommend maintaining local backups of important files.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
  • We are not responsible for the accuracy or suitability of designs created with the App for construction, manufacturing, or engineering purposes.

10. Indemnification

You agree to indemnify and hold harmless FirstOfCAD from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your right to use the App ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Apple App Store Terms

These Terms are in addition to Apple's App Store Terms of Service. In the event of a conflict, Apple's terms prevail with respect to App Store-related matters. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
